01 Audit of Financial Statements

The Employment Contract Law (LTC) Art 30 in Argentina establishes joint and several liability when there is the outsourcing of work that should be carried out by the contracting company itself and that by decision of the latter executes it by resorting to the outsourcing of those services. There is abundant jurisprudence of cases in which the solidarity between the contracting company and the contractor company and its subcontractors was determined. In the procurement or bidding processes, the contract sectors of permanent companies analyze offers from an innumerable number of bidding companies. In this process, it has under its analysis the offers and the background of the bidding companies. This service also makes it possible to analyse whether the bidder has the financial and economic capacity to meet the contract. We have databases of credit behavior in Argentina and abroad. Our professionals analyze their balance sheets and financial information in order to provide the company with ratios of its main economic-financial variables, giving scores to measure the real state of the bidders. These reports allow contracting companies to evaluate their suppliers prior to the awarding of contracts, thus avoiding awarding works-services-goods to companies with financial difficulties.

In an inflationary context, having the calculation of recurring price adjustments of contracts under procedure is a very sensitive issue. With these methodologies, the background of the contracts, their base prices, the applicable indices and the correct methodology for calculating the price adjustment polynomials are analyzed. There are contracts in dollars adjusted by price index correction factors, analysis of collective bargaining agreements, applicable indices on cost structures, analysis of different polynomial options of price adjustments of different offers received, which must be analyzed with a very precise, refined and reliable technical criterion. Our service aims to achieve transparency in the price adjustment processes, in order to ensure that the parties (contracting party and supplier) respect and accept professional judgment on a technical and transparent basis. In many cases, our services are used to train contractors to apply the methodology correctly, making this process, often conflictive, normal and in an environment of mutual respect.
