The Employment Contract Law (LTC) Art 30 in Argentina establishes joint and several liability when there is the outsourcing of work that should be carried out by the contracting company itself and that by decision of the latter executes it by resorting to the outsourcing of those services. There is abundant jurisprudence of cases in which the solidarity between the contracting company and the contractor company and its subcontractors was determined. For this reason, in our professional opinion, companies must control through labor audits the correct compliance with labor legislation in terms of payroll or salary settlements, in addition to adherence to all the formalities that the legislation requires. These audits must be random and periodic in all contracts, without distinction, in order to minimize the contingencies that would occur for the contracting company. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t
